Important Notice

This User Agreement ("Agreement") governs your use of the JirehPay mobile application ("App") and our international money remittance services. By registering for and using our services, you accept and agree to be bound by this Agreement, our Privacy Policy, and any other applicable terms and conditions.

Please read this Agreement carefully. It contains important information about your rights and obligations, including:

  • Mandatory arbitration provisions (Section 13)
  • Class action waiver (Section 13.3)
  • Limitation of liability (Section 9)

JirehPay is registered as a Money Services Business with the Financial Crimes Enforcement Network ("FinCEN") and holds money transmitter licenses in various U.S. states and jurisdictions.

1. Definitions

"Account" means your registered account with JirehPay.

"App" means the JirehPay mobile application.

"Business Day" means any day of the week. JirehPay provides 24/7 online service with customer support available around the clock.

"Payment Method" means the debit card or bank account used to fund your transfer.

"Recipient" means the person or entity receiving funds through our international remittance services.

"Remittance Transfer" means an international money transfer initiated through the App to a recipient located outside the United States.

"Security Details" means your password, PIN, biometric authentication, and other security credentials.

"Services" means the international money remittance services provided through the App.

"User," "you," or "your" means the individual using our Services.

2. Eligibility and Registration

2.1 Eligibility Requirements

To use our Services, you must:

  • Be at least 18 years of age
  • Be a legal resident of the United States
  • Have a valid U.S. payment account in your name
  • Have a compatible mobile device (iOS or Android)
  • Provide accurate and complete registration information

2.2 Registration Process

To register:

  • Download the App from the Apple App Store or Google Play Store
  • Provide required information including:
    • Full legal name
    • Valid email address
    • Phone number
    • Date of birth
    • Social Security Number (for identity verification)
    • Government-issued photo identification
  • Create a secure password
  • Set up two-factor authentication
  • Verify your identity through our verification process

2.3 Account Verification

We are required by law to verify your identity. You authorize JirehPay to:

  • Obtain information from third parties including credit reporting agencies
  • Verify your residential address and personal details
  • Conduct background checks as required by law
  • Request additional documentation as needed

2.4 Account Security

You are responsible for:

  • Maintaining the confidentiality of your Security Details
  • All activities that occur under your Account
  • Immediately notifying us of any unauthorized use
  • Regularly updating your password
  • Ensuring only your biometrics are registered on your device

3. International Money Remittance Services

3.1 Service Description

JirehPay provides international money remittance services, allowing you to send money from the United States to recipients in supported countries worldwide. Our services are designed to help diaspora communities support their loved ones abroad with secure, affordable, and fast money transfers.

3.2 Supported Destinations

We offer remittance services to various countries. The current list of supported destinations is available in the App and on our website. We may add or remove destinations at our discretion.

3.3 Delivery Methods

Depending on the destination country, funds may be delivered via:

  • Bank deposit to the recipient's bank account
  • Mobile money transfer
  • Cash pickup at designated agent locations

Available delivery methods vary by country and are displayed when initiating a transfer.

3.4 Initiating a Remittance Transfer

To send a remittance transfer:

  1. Select the destination country
  2. Enter recipient information (full legal name, contact details, and delivery method details)
  3. Enter the transfer amount
  4. Select your Payment Method (debit card or bank account)
  5. Review the exchange rate, fees, and total cost
  6. Review the estimated delivery time
  7. Confirm and authorize the transaction

3.5 Transfer Processing and Delivery

  • Transfers are processed upon confirmation and successful payment authorization
  • Delivery times vary by destination country and delivery method
  • We provide estimated delivery times but cannot guarantee exact timing due to factors beyond our control
  • You will receive a confirmation with transaction details and a reference number

3.6 Exchange Rates

  • Exchange rates are set by JirehPay and displayed before you confirm your transfer
  • The exchange rate shown at the time of confirmation is the rate applied to your transfer
  • Exchange rates may include a margin above the interbank rate
  • You are responsible for understanding the exchange rate before confirming

3.7 Transfer Limits

We may impose limits on:

  • Minimum and maximum transfer amounts per transaction
  • Daily, weekly, or monthly transfer limits
  • Number of transactions per time period
  • Limits per destination country

Current limits are displayed in the App and may change at our discretion or as required by law.

4. Cancellation and Refund Rights

4.1 Your Right to Cancel

You have the right to cancel a remittance transfer and obtain a full refund, including all fees, if the funds have not yet been picked up or deposited by the recipient.

4.2 How to Cancel

To cancel a transfer:

  • Use the Cancel button in the App (available if funds have not been sent to the recipient), OR
  • Contact customer support at info@Jireh-Pay.com

The Cancel button will be visible in the App for eligible transfers. Once the funds have been sent to the recipient, cancellation is no longer possible.

4.3 Refunds

  • Refunds for cancelled transfers will be processed within 3 business days
  • Refunds will be credited to the original Payment Method
  • If cancellation is not possible because funds have been delivered, no refund will be issued

4.4 Error Resolution

If there is an error with your transfer (e.g., wrong amount sent, funds sent to wrong recipient), contact us immediately. Under federal law (Regulation E), you have certain rights regarding error resolution for remittance transfers.

5. Fees and Charges

5.1 Fee Structure

Our fees for international remittance transfers include:

  • Service fees (vary by destination country and delivery method)
  • Exchange rate margins

All applicable fees are disclosed before you confirm your transfer.

5.2 Fee Disclosure

  • Total fees and exchange rate are shown before transaction confirmation
  • Fee schedule is available in the App and on our website
  • We may change fees with 21 days' notice
  • Additional fees may be charged by recipient banks or agents (disclosed when known)

5.3 Taxes

You are responsible for all applicable taxes related to your use of the Services.

6. Prohibited Activities

You agree NOT to use our Services for:

6.1 Illegal Activities

  • Money laundering or terrorist financing
  • Fraud or financial crimes
  • Violating U.S. sanctions or embargoes (OFAC)
  • Sending funds to prohibited countries, individuals, or entities
  • Any activity prohibited by U.S. or international law

6.2 Restricted Uses

  • Commercial or business transactions
  • Payment for goods or services
  • Gambling or gaming activities
  • Any purpose other than personal remittances

6.3 Misuse of Services

  • Creating multiple accounts without permission
  • Using false or misleading information
  • Providing inaccurate recipient information
  • Allowing others to use your Account
  • Circumventing security measures or transaction limits
  • Automated or bot usage

7. Error Resolution and Disputes

7.1 Reporting Errors

If you believe there is an error with your remittance transfer, contact us within 180 days of the transfer date. Provide:

  • Your name and account information
  • Description of the error
  • Dollar amount involved
  • Transaction reference number

7.2 Investigation Process

  • We will investigate your complaint within 90 days
  • We will provide a written response with results
  • If we determine an error occurred, we will correct it within one business day

7.3 Your Rights Under Federal Law

For remittance transfers, you have rights under the Electronic Fund Transfer Act (Regulation E), including:

  • Right to receive a receipt with transaction details
  • Right to cancel before funds are delivered
  • Right to error resolution
  • Right to receive refunds for certain errors

7.4 Unauthorized Transactions

  • Report immediately if you suspect unauthorized access to your Account
  • We will investigate and resolve unauthorized transaction claims promptly
  • Your liability may be limited under applicable law

8. Privacy and Data Security

8.1 Data Collection and Use

  • We collect and process personal data as described in our Privacy Policy
  • You consent to data processing necessary for service provision
  • We may share data with service providers, partners, and as required by law
  • We comply with applicable data protection laws

8.2 Security Measures

We implement:

  • Encryption of sensitive data in transit and at rest
  • Multi-factor authentication
  • Regular security audits
  • PCI DSS compliance
  • Fraud monitoring systems

8.3 Your Security Obligations

You must:

  • Keep Security Details confidential
  • Use strong, unique passwords
  • Enable two-factor authentication
  • Report suspicious activity immediately
  • Keep your device and app updated

9. Liability Limitations

9.1 Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9.2 Limitation of Liability

To the maximum extent permitted by law:

  • Our liability for any transfer is limited to the transfer amount and fees paid
  • We are not liable for indirect, consequential, incidental, or punitive damages
  • We are not responsible for delays or failures caused by third parties, recipient banks, or agents
  • We are not liable for losses due to circumstances beyond our reasonable control

9.3 Exceptions

These limitations do not apply to:

  • Rights and protections under Regulation E for remittance transfers
  • Gross negligence or willful misconduct by JirehPay
  • Violations of applicable law

10. Indemnification

You agree to indemnify and hold harmless JirehPay, its affiliates, directors, employees, and agents from any claims, losses, or damages arising from:

  • Your violation of this Agreement
  • Your use of the Services
  • Your violation of any law or third-party rights
  • Inaccurate information you provide
  • Unauthorized use of your Account

11. Term and Termination

11.1 Term

This Agreement is effective upon your acceptance and continues until terminated.

11.2 Termination by You

You may close your Account at any time by:

  • Contacting customer support
  • Following the account closure process in the App

11.3 Termination by Us

We may suspend or terminate your Account:

  • For violation of this Agreement
  • For suspected fraudulent activity
  • As required by law or regulatory order
  • For extended inactivity (12+ months)
  • At our discretion with 60 days' notice

11.4 Effect of Termination

Upon termination:

  • Pending transfers will be completed or cancelled
  • You remain liable for obligations incurred
  • Sections that naturally survive will remain in effect

12. Intellectual Property

12.1 Ownership

  • The App and Services are owned by JirehPay
  • All trademarks, logos, and content are our property
  • You receive a limited license to use the App

12.2 License Grant

We grant you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only.

12.3 Restrictions

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or decompile the App
  • Remove copyright notices
  • Use our trademarks without permission

13. Dispute Resolution

13.1 Informal Resolution

Before initiating formal proceedings, you agree to attempt informal resolution by contacting info@Jireh-Pay.com.

13.2 Arbitration Agreement

Please read carefully — this affects your legal rights.

Any disputes arising from this Agreement or your use of the Services will be resolved through binding arbitration under AAA Commercial Arbitration Rules, except:

  • Small claims court actions (if eligible)
  • Injunctive relief for intellectual property violations

Opt-Out Right: New users may opt out of arbitration within 30 days of registration by emailing info@Jireh-Pay.com with subject line "Arbitration Opt-Out."

13.3 Class Action Waiver

You waive the right to participate in class actions, class arbitrations, or representative actions. All disputes must be brought in your individual capacity.

13.4 Governing Law

This Agreement is governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law provisions.

14. Communications

14.1 Electronic Communications

You consent to receive all communications electronically, including:

  • Transaction confirmations and receipts
  • Account notifications
  • Legal notices and policy updates
  • Marketing communications (with your consent)

14.2 Communication Preferences

You may manage communication preferences in your Account settings.

14.3 SMS/Text Messaging

By providing your phone number, you consent to receive:

  • Security alerts and verification codes
  • Transaction notifications
  • Transfer status updates

Standard message and data rates apply.

15. Changes to This Agreement

15.1 Modifications

We may modify this Agreement at any time. We will provide:

  • 21 days' notice for material changes affecting fees or liability
  • Notice through the App or email
  • Updated terms on our website

15.2 Acceptance of Changes

Continued use after changes take effect constitutes acceptance. If you disagree with changes, you may close your Account.

16. Miscellaneous

16.1 Entire Agreement: This Agreement, including incorporated policies and terms, constitutes the entire agreement between you and JirehPay.

16.2 Severability: If any provision is invalid or unenforceable, the remaining provisions continue in effect.

16.3 Waiver: No waiver is effective unless in writing. Failure to enforce any provision is not a waiver.

16.4 Assignment: You may not assign your rights or obligations. We may assign this Agreement without restriction.

16.5 Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control, including natural disasters, war, government actions, or failures of third-party systems.

16.6 English Language: This Agreement is in English. Translations are for convenience only; the English version controls.

16.7 Survival: Provisions that naturally survive termination remain in effect, including liability limitations, indemnification, and dispute resolution.

17. Regulatory Disclosures

17.1 Money Transmitter Licenses

JirehPay is licensed as a money transmitter in applicable U.S. states. License information is available upon request.
